Privacy Policy

This is a starting template, not legal advice. Bentley Offshore should have this reviewed by a Nigerian lawyer — particularly against the Nigeria Data Protection Act 2023 (NDPA) and the NDPC's General Application and Implementation Directive — before relying on it, since it collects seafarer documents and personal data. This policy does not state whether Bentley Offshore is registered with the Nigeria Data Protection Commission (NDPC); confirm registration status and any filing obligations with counsel before publishing.
1. Who We Are
Bentley Offshore Services Nigeria Limited ("Bentley Offshore", "we", "us") is a crew management and marine services company registered in Nigeria (RC 9652824), with its registered office at 2, Oyibo Layout, Shagolo, Ekpan, Warri, Delta State, Nigeria. This policy explains how we handle personal information in connection with this website, bentleyoffshore.com.
2. Information We Collect
Crew registration happens on an external form, not on this site. The Request Crew form on this site is the one data-collection form this website itself contains. Personal information reaches us through the following channels:
- Crew registration — the "Join Our Crew" links on this site open an external Google Form. Information you submit there — including name, contact details, and maritime documents and certifications — is collected by that form and shared with Bentley Offshore; it is also subject to Google's own privacy policy as the form's host.
- Employer crew requests — the "Request Crew" form on this site submits the company, contact and crew requirement details you enter directly to Bentley Offshore, using a server-side function running on Cloudflare's infrastructure that relays your request to our inbox by email via Resend, a transactional email provider. Before your request is processed, Cloudflare Turnstile checks that the submission is from a person rather than automated software; this involves Cloudflare evaluating signals such as your browser and IP address. Neither Cloudflare nor Resend uses the information you submit for their own purposes — they process it only to deliver your request to us.
- Direct contact — information you provide when contacting us by phone, WhatsApp, or email.
- Browser storage — this site stores one small preference (your cookie banner choice) in your browser only, and does not use tracking or analytics cookies. See our Cookie Policy for the full detail, including the third-party services (Google Fonts, WhatsApp, Google Forms, Cloudflare Turnstile) that your browser contacts directly when you use this site.
3. Legal Basis for Processing
Under the Nigeria Data Protection Act 2023, we process personal information on the following bases: your consent (for example, when you voluntarily register through the crew form or contact us); the steps necessary to consider you for, or move forward with, a placement you've applied for; and our legitimate interest in maintaining accurate crew records and responding to enquiries, balanced against your rights.
4. How We Use Information
- To assess and verify crew registrations and maintain accurate crew records.
- To consider registered individuals for marine and offshore opportunities as they arise.
- To respond to enquiries from prospective crew and from companies seeking crew.
- To assess the staffing or crew requirements described in a Request Crew submission, and to communicate with the submitting company about the personnel requested.
- To meet legal, regulatory and safety obligations relevant to crew management.
5. Sharing of Information
We may share relevant crew information with vessel operators, employers and recruiters considering a registered crew member for a specific opportunity. We do not sell personal information. Where a third-party service provider (such as Google, for the registration form; Cloudflare, for website hosting and bot verification; or Resend, for delivering Request Crew submissions to our inbox) processes information on our behalf or as part of its own service, that provider's own privacy policy also applies — see section 2.
6. Data Retention
We retain crew and enquiry records for as long as needed to support crew placement, and to meet legal and regulatory requirements. Records no longer needed for these purposes are deleted or anonymised within a reasonable period.
7. Cookies and Similar Technologies
This website does not use tracking, advertising, or analytics cookies. Full detail on what is and isn't stored in your browser, and the third-party services this site loads resources from, is in our Cookie Policy.
8. Your Rights Under the Nigeria Data Protection Act 2023
Subject to the conditions set out in the NDPA, you have the right to: be informed about how your information is processed; access the personal information we hold about you; request correction of inaccurate information; request erasure or restriction of processing in certain circumstances; object to processing based on legitimate interest; request data portability; and withdraw consent at any time where processing is based on consent, without affecting processing carried out before withdrawal. You also have the right to lodge a complaint with the Nigeria Data Protection Commission (NDPC) if you believe your information has been mishandled. To exercise any of these rights with us directly, use the contact details in section 11.
9. Children's Data
This website and its crew registration process are intended for maritime professionals of working age and are not directed at children. We do not knowingly collect personal information from minors through this site.
10. Security
We take reasonable technical and organisational measures to protect the personal information we hold from loss, misuse, or unauthorised access. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.
11. Changes to This Policy
We may update this policy from time to time — for example, if we add new tools or services to the site. The "Last updated" date at the top will reflect the most recent revision. If we introduce analytics or any tool that changes how cookies or similar technologies are used, this policy and our Cookie Policy will be updated first.
